Terms of Service Agreement
This agreement is between I, the Artist, and you, the Client, for work services performed on a project known as the Work.
Content
I, the Artist, have the right to refuse projects and requests according to my discernment and capabilities. Some content that I will not be comfortable with representing include:
- Gore
- Extreme fetish NSFW
- Character and creature models or other highly complex models
- NFTsI, the Artist, warrant that the Work will be my original work performed to the best of my ability.
Timeline & Process
The completion of the Work requires 1 week at minimum, and may typically average 1 week to 1 month, depending on commission type, complexity, and workload of commissions. Deadlines and timelines will be adhered to in good faith but may not be possible sometimes. Note that each project may vary. Please plan your launches and streams accordingly.There may be no major revisions for each item shown during the process, not including mistakes made by the Artist. Revision later in the process such as after model completion can only be minor. I will actively reach out for feedback.Additional charge may be required for further revisions that may impact the progress and timeline of the project.Delivery of finished Work will be through Discord DMs or Google Drive. Do note that I may delete the model from the drive after an unspecified amount of time to facilitate the delivery of Works for other Clients. I will inform you of this deletion ahead of time. Discord may delete a file unannounced, which I cannot prepare you for.
Communication
Communication will take place throughout the entire project timeline with updates. I will typically ask for feedback when I have something to show. I will let you know if anything is causing delays or priority shifts in the project.I will use Twitter or Discord DMs to facilitate communications and track status updates on a Trello board. I will typically respond quickly but may also take up to 1 week, which is usually in order to provide a better, more concrete, update.Clients agree to provide all required art, references, information and assets before Work starts and during the process, or it can affect the timeline.
Rights, Usage & Credits
I retain original copyright and ownership of the Work, which includes but may not be limited to advertising, displaying the Work in my websites, social media and portfolios according to my discretion. I have rights to repurpose unused and used process work for future projects, personal or otherwise.The process and images of the final Work will likely be posted on Twitter and/or streamed on Twitch unless Clients request otherwise before project begins.Clients are granted exclusive rights for personal use and partial Commercial rights of the Work produced as agreed upon, which must not be transferred to any other parties.
Personal use includes: Social media profile pictures, wallpapers, personal website display and social media posts that is not for sale or distribution to any other party.
Partial commercial rights include: usage on streams, broadcast content and any content derived from these (i.e. clips, compilations), worlds and non-public avatars for Virtual Reality social platform like VRchat.Clients may not at any time modify, edit, change the Work without permission from the Artist.Unless discussed with me, the Client may not share the Work with others or use it under another name. This includes online aliases.Unless specified in the commission information or otherwise discussed and agreed upon, full commercial licenses and reselling rights are not included.
Full commercial means any monetized work including but not exclusive to: merchandise, videos not derived from broadcasted streams, music releases, games.
Reselling rights means selling the Work to another party or another platform. This includes giving the Work away for free or as a part of another Work (i.e. a Vtuber or VRchat avatar).Any Work done or made available to the Client must not be used for or as promotion for NFT or any blockchain purposes. The client must also not create, own, or buy NFTs in the future.Any Work and related media done or made available to the Client must not be used for the training of artificial intelligence.Full commercial licenses may require additional charges on a case-by-case basis.Clients may not claim Work as their own or anyone else’s and therefore must credit me as the Artist using my social tag/username Pix, Pix_VT, PixVtuber or any other variations. A link to at least one my social media pages (i.e. Twitter, Twitch) is also required.
Payments, Cancellation, Refunds
Before starting the project, the Client is not required to pay any amount.Invoices will be sent after the full model has been completed. Do not send a payment without my request.When invoice or payment link is received, the Client agrees to pay within 72 hours unless circumstances are communicated otherwise in advance, or the project may be cancelled by the Artist.The Work will not be send until payment has arrived in the Artist account.If Client requests cancellation, any completed parts can be requested by the Client at a discounted price, depending on completion.If for any unforeseen reason I cannot complete the Work or the Work is significantly delayed by 3 months past deadline, I will take initiative to inform you and provide a partial or full refund, should any money have been transferred.A model may be complexer than initially thought, which may increase the price. Potential difficulties will be discussed before starting the process and a change in price will be discussed before payment.Prices are in USD, and preferably paid via Stripe, although PayPal invoice is also a possibility. Prices may change depending on complexity of the commission.By engaging on any project, once Work has started the Client acknowledges the product and deliverables are DIGITAL and there is no physically shipped good to receive. Chargebacks are not permitted and the refund policy as mentioned before will be followed.
